Nellya Fencers Waiver
NOTICE AND WAIVER FOR FENCERS UNDER 18 YEARS OLD
I warrant and represent that i am the parent or legal guardian of the athlete.
I understand that, although fencing, according to the united states fencing association, is a relatively safe sport, the possibility of injury or death exists. to the best of my knowledge the athlete can fully participate in this activity.
I understand and agree that nellya fencers, its agents, board members, successors, and assigns will not ensure and are not responsible for protecting the athlete from injury or death. to that end, i understand and agree that i am solely responsible for making sure that the athlete has and wears proper fencing equipment and that i am solely responsible for verifying the condition and proper wearing of equipment. i further understand and agree that nellya fencers and its agents, board members, successors, and assigns will not supervise the athlete and cannot be and are not responsible for supervising the athlete, while fencing or otherwise.
I have read, understand, and agree to the above and have explained it to the athlete. in consideration of the athlete’s participation in nellya fencers and for other good and valuable consideration, the undersigned does hereby covenant not to sue and releases, waives, discharges, and holds harmless nellya fencers, its agents, board members, successors, and assigns from any and all liability, claims, demands and actions arising out of or related to any and all loss, damages, injury, or death that may be sustained by the athlete, including without limitation any medical costs.
